Legal protection for patients receiving emergency healthcare services continues to face challenges related to potential refusals or delays in treatment arising from administrative requirements, health insurance eligibility, and financial considerations. These circumstances indicate that the existence of statutory regulations alone is insufficient to ensure the effective protection of patients’ rights without adequate legal understanding and compliance. This study aims to analyse the legal framework governing patient protection in emergency healthcare services and to develop a preventive legal protection model grounded in legal education and Soerjono Soekanto’s Theory of Legal Awareness. This study employs normative legal research using statutory and conceptual approaches. Primary and secondary legal materials, together with supporting materials, are examined through qualitative analysis and prescriptive legal reasoning. The findings indicate that Law No. 17 of 2023 on Health, particularly Articles 173, 174, and 176, provides a normative foundation for healthcare facilities’ obligations to safeguard patient safety and provide emergency care without refusals or delays prohibited by law. Building on this framework, the study proposes a preventive legal protection model integrating statutory obligations, health law education, four indicators of legal awareness, institutional compliance governance, and internal oversight. The proposed model is expected to strengthen institutional legal compliance and help prevent violations of patients’ rights in emergency healthcare settings.References
