Permasalahan Waris seringkali menjadi sumber perseteruan antar ahli waris, sehingga harus jelas pengaturannya mengenai pembagian dan pemisahan hak warisan untuk para ahli waris. Akan tetapi, tidak ada ketentuan yang mengatur secara tegas selanjutnya timbul pertanyaan lain bagaimanakah pembagian warisan terhadap anak yang dalam kandungan apakah dapat ditentukan pada saat anak tersebut masih dikandungan atau tidak, sehingga menarik untuk diteliti mengenai hak waris bagi anak dalam kandungan berdasarkan hukum waris Islam di Indonesia beserta pengaturan mengenai pembagiannya.
